This is the official Privacy Policy of insignia Pty Ltd and it applies to the personal information collected by us.

In this policy, "us", "we" or "our" means insignia Pty Ltd (ABN 65 086 314 025).

It applies to all personal information collected by us, including via www.insignia.com.au and any related insignia website or social media page, and from an individual via any means, including physically or electronically. By visiting or using our website you agree to the collection, storage, usage, and disclosure of your personal information by us in the manner described in this Privacy Policy.

We are committed to ensuring the privacy of personal information provided to the company by customers, employees, vendors, business partners, and other stakeholders. This policy contains information on how and why we collect your personal information, how we may use and disclose that information, and keep it secure. This policy also outlines how to access and correct your personal information and what control you have over our use of that information.

This policy is a public document and has been developed to provide transparency and openness in relation to personal data collection and management. This Privacy Policy is based on the Australian Privacy Principles contained in Schedule 1 in the Privacy Amendment (Enhancing Privacy Protection) Act 2012 which amends the Privacy Act 1988.

2. Information you provide to us

We may collect and hold personal information about you where the information is necessary for us to carry on our business and provide our services. This information is provided by you directly to us, for example when you make a purchase, create an online account, or subscribe to our mailing list. This personal information may include:

  • Your full name
  • Your contact details including email address, delivery address and phone number
  • Your place of work, job title and ABN
  • Your contact preferences
  • Banking details for processing payments at the time of order.

Your personal information will be collected in accordance with the requirements of the Privacy Act. If the personal information you provide us is incomplete or inaccurate, we may be unable to provide you, or someone else you know, with the products or services that you, or they, are seeking.

Financial information that is collected via the website or new account application is used by insignia to invoice you for products and services ordered. This information may be collected at the point of order but is processed using a secure gateway therefore this information is not held.

3. Information we collect from your use of our website

When you visit our website, our Internet Service Provider automatically records the following information about you:

  • Device information, including the operating system, preferred language, unique device identifier and mobile network.
  • Location information: if you permit our website to access location services on your mobile device, we may collect the precise location of your device. On desktop computers, the country where you are located is recorded.
  • Website usage: we collect information about how you interact with our website, including the page/s you visit, the time spent on each page, the date and time of your visit, and the website you visited immediately prior to ours.

The personal information that we collect and hold about you depends on your interaction with us.

Generally, we will collect, use and hold your personal information if it is reasonably necessary for or directly related to the performance of our functions and activities and for the purpose of:

6. Use and disclosure of information

Generally, we only use or disclose personal information about you for the primary purpose for which it was collected (as set out above).

We will not sell, rent or lease personal information to a third party, except where consent has been obtained. However, personal information may be transferred to our service providers who can support us in delivering our products and service to you. These service providers include but are not limited to employees, contracted agents, delivery companies, mail houses, web hosting organizations and information technology providers, and third party fulfilment contractors.

Currently, the majority of our service providers are located in Australia however, some service providers may be located overseas, primarily in New Zealand, America, and Ukraine. As a result, personal information collected and held by us may be transferred overseas. Please note that Australian law may not apply to some of these entities.

You consent to that disclosure and agree that by giving that consent, APP 8.1 (cross-border disclosure of personal information) no longer applies, and we are not required to take reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to that information.

Other circumstances where we may use or disclose your personal information:

  • Where you have provided consent for use or disclosure;
  • Where required by law or law enforcement and government agencies;
  • Where we reasonably believe that the use or disclosure of personal information can prevent or avoid imminent threat to persons health and safety or the public health and safety.

8. Storage and security of information

We store your personal information in different ways, including in paper and electronic form. We understand the importance of keeping your personal information secure. We take all reasonable measures to ensure that your personal information is stored safely to protect it against loss, misuse, unauthorized access, modification and/or disclosure. We protect secure data with industry-standard firewall and password protection systems which are only accessible by authorized staff. Even after you cancel or close your account with us, we will retain your information for as long as we reasonably need it for the purposes outlined in this Privacy Policy.

Our service providers and employees who have access to your information have been made aware of the requirements of the Privacy Act and their responsibilities.

9. Notifiable data breaches

In the event of a data breach, we will take all reasonable steps to contain the breach, and where possible will take immediate steps to limit any further access or distribution. If we have reasonable grounds to suspect the data breach is likely to result in serious harm to any affected individuals, we will take reasonable steps to ensure an assessment is completed within 30 days of the breach. If remedial action is successful in making serious harm no longer likely, then no notification or statement will be made. When we are aware of reasonable grounds to believe serious harm is likely, as soon as practicable, we will notify each of the individuals whose data was breached or who are at risk. This notification will contain information regarding the breach and recommendations of the steps the individual should take. We will also provide a copy of the statement to the Office of the Australian Information Commissioner.

10. Access and correction of information

We take reasonable steps to ensure your personal information is held in a manner that is accurate, complete, relevant and up to date by updating our records whenever true and correct changes to the information are made known to us. You have the right to access your personal information held by us, in accordance with the Privacy Act. If you wish to access or correct your information you can do so by:

Access to the information will generally be granted within 14 days of the written request received by the Privacy Officer and once the identity of the individual has been verified. We may charge you a reasonable fee for processing the request that is complex or is resource intensive (but not for making a request for access).

We may decline a request for access to personal information in circumstances prescribed by the Privacy Act, and if we do, we will provide you with a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons).

If, upon receiving access to your personal information, or at any other time, you believe the personal information we hold about you is inaccurate, incomplete or out of date, please notify us immediately. We will take reasonable steps to correct the information so that it is accurate, complete and up to date.

If we refuse to correct your personal information, we will provide you with a written notice that sets out the reasons for our refusal (unless it would be unreasonable to provide those reasons) and provide you with a statement regarding the mechanisms available to you to make a complaint.

11. Opting out of marketing and promotions

We may send you direct marketing communications and information about our products that we consider to be of interest or value to you. These communications may be sent via telephone, email, or post using the personal information provided by you. We do not send advertising or marketing information unless we have your express or inferred consent in accordance with Australian laws. If you no longer wish to receive these types of communications, you may remove your name from our database either by using the opt-out facilities provided in the marketing communications or by contacting us via the contact details in this Privacy Policy.

12. Complaints

Any complaint should include the date, time, and circumstances of the matter, how you believe your privacy has been breached and how you would like your complaint resolved.

We will take reasonable steps to investigate your complaint and attempt to resolve any breaches in accordance with the applicable legislation in a reasonable timeframe. If you are not satisfied with the procedure and outcome, you may request that an independent person investigate your complaint and you may also complain directly to the Office of the Australian Commissioner.
